Monday, May 2, 2022: My position on expungements

Hey! It’s Julianne Murray and I am here for our Murray Monday Minute.  

I have been asked about my position on expungements1, wrote them down, so I made sure I hit everything.

  1. Question one was, what is my position on expungement.  Is it for all Delawareans or just people seeking firearms?  The answer is, all Delawareans.

  2. Question two, what’s my position on expungement after a certain period of time, if the person has gone on to be law abiding? and my answer to that is, it depends on the crime, okay.  I don’t think that we can have a set period of time because there is a huge difference between a misdemeanor property crime and a felony crime against the person, but do I think that someone if they’ve proven to be law abiding should be eligible? Yes.

  3. Number three, what’s my position on the, the procedure or policy that violent crimes and crimes against children, people who have been convicted of that being ineligible for expungement.  Do I agree with it? And the answer is no.  I truly believe that expungement should be on a case by case basis.  Someone who is convicted of assault second for a fight in college that involved serious physical injury who goes on to be a law abiding citizen should be able to clear their record.

  4. Last question, do I think that there are certain crimes that should be ineligible?  Yes.  Class A Felonies2.  They are the most serious crimes and I think they should be on a person’s record for the rest of their life.
