Hey, it’s Julianne Murray and I am here for our Murray Monday Minute.
This week and in upcoming weeks we are going to be talking about the constitutionality of statutes, things that the general assembly have been passing, and before I get to that I want to kind of give you some ground work.
The US Constitution1 is the supreme document underneath that is the Delaware Constitution2 and then under that is statutes.
So, when someone talks about whether a statute is constitutional or not, it can fall under two different categories. It has to be constitutional for the Delaware Constitution as well as the US Constitution.
So, let us talk about HB4503 [AN ACT TO AMEND THE DELAWARE CODE RELATING TO DEADLY WEAPONS.]
A lot going on this week, about whether or not it is constitutional that was passed this week related to firearms.
This is a couple of pages out of 450 that is banning firearms, banning them going forward. The general assembly is calling it a discontinuation from going forward, but it is a firearms ban.
So, is it constitutional or not?
Well, US Constitution says you shall have the right to bear arms.
Delaware Constitution says a person has the right to keep and bear arms for the defense of self, family, home, and state and for hunting and recreational use.
So, we are going to let the court sort it out.
I know people are really, really upset about it, but let’s let the courts do their job. I think it is going to be ruled unconstitutional, but I guess we are just going to have to see.
