Recent ATF Visit to a Delawarean

Monday, July 25, 2022: You also have the right to remain silent when something like this happens, use it

Hey, it’s Julianne Murray here for our Murray Monday Minute.  

Baking at the Delaware State Fair.  Thanks to everybody who has stopped by and been supportive.  We are trying to talk to a whole lot of people.

Okay, the topic this week.  There was a video that came out last week that has gone viral, that has two ATF agents and a DSP, I will say trooper - I don’t know that it is a trooper, DSP member that showed up on a guy’s doorstep saying that they were researching straw purchases and asked to see one of his weapons.

My e-mail, social media, everything has blown up asking what I think about this and whether or not it was legal case or a couple of different things.  

What I do think about it.  I know the straw purchases1 are a big deal.  For those who don’t know.  That’s basically where a lawful person buys it for somebody who is prohibited.  

So, targeting them is a big deal okay, and I know that our current AG has said that she is targeting straw purchases, but showing up on law abiding citizens’ doorsteps bothers me.

Okay, so was it constitutional?  Yes, because he gave consent, fourth amendment. You don’t have to worry about the fourth amendment if the arm owner gives consent and the way that they worked and talked to him he basically went ahead and said, yeah, I’ll get you the gun and showed it to them.

So, what would you do if this happens?

Okay, number one. You don’t have to open the door.  If you do, I think, you should step outside, close the door to your house so that you are on your front porch.

Absolutely appropriate to ask for credentials of the person that is there and it is also appropriate to ask and you should ask, do you have a warrant?  

If they do not have a warrant, stop the conversation.  You can’t help yourself there. Don’t be rude.  Just be direct.  Say, if you don’t have a warrant, I am done talking, have a nice day, please leave my property and go back inside.

Anything other than that could be turned in to consent.  

You have the right to remain silent when you are under arrest.  You also have the right to remain silent when something like this happens, use it.

I told you I was going to be fearless.
